Athens, Greece – A criminal complaint has been filed against Prime Minister Kyriakos Mitsotakis, former and current Ministers of Transport, railway executives, and regulatory authorities by Evdokia Tsagli, a survivor of the Tempi train crash that occurred on February 28, 2023. The tragedy, which resulted in at least 57 deaths, has been widely attributed to systemic failures, government negligence, and corruption, leading to deliberate concealment of evidence.

The complaint, submitted to the Prosecutor of the Court of First Instance in Larissa, outlines a series of political, administrative, and judicial failures that enabled the disaster and now threaten to obstruct justice. The Greek government and railway authorities are accused of knowingly operating an unsafe railway system, obstructing investigations, and tampering with key evidence related to the causes of the crash, particularly the mysterious explosion and fire that engulfed the train.

Government Knew About the Risks but Took No Action

The complaint highlights that the Greek railway system had been operating for years without essential safety infrastructure, despite multiple warnings from European agencies, railway workers, and even the Greek Parliament. Key failures include:

  • Lack of an automated signaling system: Despite billions in EU funding, crucial railway safety mechanisms were never properly implemented or maintained. The crash could have been avoided if the system was operational.
  • Understaffing and mismanagement: The Larissa railway station, where the accident occurred, was severely understaffed, with one overworked stationmaster manually controlling all traffic due to massive staff shortages and poor training.
  • Failure to enforce EU railway safety regulations: The complaint points out that Greece failed to comply with European safety directives, allowing trains to run on a system that lacked even the most basic safeguards.

Despite these longstanding and well-documented issues, the government ignored multiple warnings and deliberately prioritized cost-cutting over passenger safety.

Cover-Up and Destruction of Evidence

Following the disaster, the Greek government and regional authorities engaged in actions that suggest an attempt to conceal the true causes of the crash:

  1. Tampering with the accident site:
    • Just three days after the disaster, authorities entered the crash site and removed crucial evidence without any judicial approval.
    • The Thessaly Regional Governor, along with Transport Ministry officials, formed a secret “emergency response committee” to alter the scene before formal investigations could begin.
    • Key forensic evidence, including wreckage and possible hazardous cargo, was removed or destroyed without proper documentation.
  2. Unexplained Fire and Explosion:
    • A powerful fire and explosion erupted upon impact, burning dozens of passengers alive.
    • Independent experts found traces of xylene, a flammable industrial chemical, at the crash site, yet the government failed to investigate how such substances ended up on the train.

Judicial Interference and Delays in Prosecution

Despite the overwhelming evidence of criminal negligence, fraud, and obstruction of justice, the Greek judicial system has been slow to act, with prosecutors delaying key indictments and failing to hold high-ranking officials accountable.

  • Victims’ families and survivors have been forced to submit their own criminal complaints because prosecutors have been reluctant to press charges against government figures.
  • The European Public Prosecutor’s Office (EPPO) is investigating **corruption and misuse of EU funds** related to railway infrastructure projects.

European Involvement and International Implications

The European Public Prosecutor’s Office (EPPO) is now conducting a parallel investigation into financial crimes related to Greece’s railway system.

  • Two former Ministers of Transport, as well as 27 other government officials and railway executives, are being investigated for fraud, embezzlement, and criminal mismanagement of EU funds.
  • Survivors and victims’ families have called on the European Parliament, the United Nations, and international human rights organizations to pressure Greece into conducting an independent and transparent investigation.

The Fight for Justice

Evdokia Tsagli’s criminal complaint is part of a growing movement demanding justice for the victims. Survivors and families are calling for:

  1. Full accountability for government officials who knowingly allowed unsafe trains to operate.
  2. An independent investigation into the cause of the explosion and fire.
  3. Prosecution of those responsible for misusing EU funds meant for railway safety.
